Judge dismisses race-based abortion law challenge

PHOENIX —A federal judge on Thursday threw out a challenge to a 2011 Arizona law banning abortion based on the race or sex of the child.

U.S. District Judge David Campbell said the two groups who filed suit contend the statute “stigmatizes and denigrates their members on the basis of race and gender,’’ based on comments by a sponsor that Asian women abort girls because they prefer boys and black women are more likely to be talked into terminating a pregnancy.

But Campbell said there is nothing in the claim that shows any individual has suffered a personal injury because of what the Legislature enacted, beyond psychological consequences. And that, he said, means they have no right to challenge the law.

The 12-page ruling does not mean the law is constitutional. That remains an open question until a woman who is denied an abortion under the law, and therefore is directly affected, challenges it. A doctor prosecuted for performing such an abortion also would have legal standing.
