Undercover NYPD officer arrested in motorcycle/SUV melee
Source: USA TODAY
The New York City Police Department confirms an undercover police officer has been arrested in connection with the Sept. 29 videotaped Manhattan melee between motorcyclists and a motorist and his family in an SUV.
Wojciech Braszczok has been charged with riot and criminal mischief, Detective Brian Sessa of the NYPD's public information unit said Tuesday night. Sessa did not have details of the arrest or of Braszczok's role with the department or of what sort of penalties Braszczok might face.
A telephone message was left with Philip Karasyk the man WCBS in New York reports is Braszczok's lawyer but Karasyk did not immediately return that call.
Braszczok is one of at least three NYPD officers who took part in the ride and subsequent brawl that left a motorcyclist with crippling injuries and the SUV driver with lacerations. Four bikers have been criminally charged in the incident.

(6,241 posts)that was part of the assault on the driver of the SUV. He needs to be charged for far more than just 'criminal mischef'. If two men are robbing a store, and guy A shoots the clerk, guy B will also be charged in the murder.

Not to take away from the seriousness of this post, but I've long thought the same thing.

(62,444 posts)"FART" makes the "fart" sound too, but it is still four letters.
All of them should be arrested. They were clearly operating in a rehearsed and orchestrated mechanism to attack an innocent victim. Saw another video of the same exact bunch of criminals pulling the same exact shenanigans on the driver of a Prius.

(53,661 posts)The article only says that, not that he actually was one of those who assaulted Lien. If he was there to get the goods, it seems he would be in the clear.
The arrest sounds like more than 'just being there' but I don't know what those kind of charges cover. Just crewing around with traffic could be criminal mischief.
About rioting, the chase scene was like a riot in slow motion. These cops could have called for back up to stop the violence.
Of course, the article was very short and I'm not a cop, etc.

(62,444 posts)If he wasn't doing something illegal, then NYPD may have some exposure here on some kind of theory of duty.

(53,661 posts)If he battered the SUV or assaulted the driver, he should be charged with that. As a LEO, he knew better.
All I know of undercover is what the media shows, and they act the same as whoever they are with most of the time. Someone posted that this is not the only incident with this group or one similar in the area, they went after a Prius before, so I can see where the authorities sent someone undercover to get names and locations and evidence...
The entire event is disturbing, to put it mildly. I would not want to do 'undercover.' Heck, I wouldn't want to be a LEO, period.
Thanks for your reply.

(11,065 posts)There was no reason to actually take part in beating on the SUV in order to preserve his cover. Many other bikers didn't attack the vehicle or the driver. He was supposed to be there. That was his assignment which the media have finally figured out but should have known from the first when he first lied to his superiors and claimed he wasn't involved in the criminal mischief and said he did nothing because he was attempting to preserve his cover. In other words, if he was worried about his cover than he was on assignment to infiltrate this group. Which stands to reason that if other officers were also on the ride they were also assigned to infiltrate the group... it hardly makes sense to put in one undercover in a group of about 1000 bikers.
When the media first found out about an undercover cop on the ride they should have found out if he was assigned to infiltrate the biker group and not yapped it all over the public first thus destroying the whole operation. Now the bikers know that there was at least one undercover that infiltrated their group and to be wary of any other new people.
