SPLC files suit challenging Alabama's laws on same-sex marriage
Source: Montgomery Advertiser
The Southern Poverty Law Center has filed a lawsuit challenging Alabama laws that refuse to recognize same-sex marriages on behalf of a Montgomery man whose husband was killed in a car crash.
The suit seeks to overturn the states Marriage Protection Act and the Sanctity of Marriage Amendment, which ban the recognition of same-sex marriages from other states.
It also seeks to allow Hard to receive proceeds from a wrongful death lawsuit involving his husband, David Fancher, and to issue a new death certificate showing Hard as Fanchers surviving spouse.
The suit claims that the laws violate the constitutional principles of due process and equal protection.
