[UPDATED BELOW] My co-bloggers Ilya Somin, Jon Adler, Orin Kerr and Will Baude not to mention Ben Wittess withering critique over at Lawfare have already dissected President Trumps executive order (misleadingly titled Protecting the Nation from Terrorist Attacks by Foreign Nationals) (full text here) and addressed many of its more appalling features, including its cruelty, ineffectiveness and the truly staggering incompetence with which it was drafted.
But theres more. Wittes correctly points to the absence of any rational relationship between the countries targeted by the ban and any expected counterterrorism goods.
The 9/11 hijackers, after all, didnt come from Somalia or Syria or Iran; they came from Saudi Arabia and Egypt and a few other countries not affected by the order.
Update: Some commenters, fairly, suggested that there could be alternative explanations for the inclusion/exclusion, and that this doesnt, standing alone, constitute malfeasance. Fair enough perhaps the answer to the question I posed in the headline is Were not sure but it sure as hell could be." So I think it is fair, at the least, to demand that he step down until he releases all of his financial information so we can figure out for ourselves whether or not our fears are justified.

(17,216 posts)It is self-defining. "High crimes and misdemeanors" is just so much window dressing. If you look at how impeachment has been deployed throughout history (most of the examples are British, and from the 17th century at that), you will find that impeachment occurs when the legislature has the desire and leverage to impeach somebody. It is almost always used for partisan politics, and some "offense" is manufactured to look good on paper.

So yes, this is a fair question and yes, he should step down until he has fully, clearly and completely separated himself from his business interests which he has NOT done to date.
