The Court Has Issued Summons to McConnell related to the Garland Nomination.

'On 09/03/2019, Equal Vote America Corp. (EVA) has filed a civil lawsuit against Mitch McConnell and Charles Grassley at the U.S. District Court for the Southern District of New York (CASE # 1:19-cv-08178) because of their complete obstruction of Chief Judge Garland’s nomination to fill a vacancy on the Supreme Court during 2016.

Today, the District Court has duly issued the summons to the two named defendants:

MITCH McCONNELL in the capacity of the Senate Majority Leader, and
CHARLES GRASSLEY in the capacity of the Chairman of the Senate Judicial Committee
The case has been assigned to District Court Judge Denise L Cote, who has ordered the initial conference to be held on November 22nd, 2019 at 11:30 A.M. in Courtroom 18B, 500 Pearl Street, New York, NY 10007. The court session is open to the public, first come first seated.

As of today, more than 6,500 Fellow Americans have signed the Online Affidavit to join as co-plaintiffs. This has become the largest grass-root ordinary citizenry legal action to defend our constitutional rights for due process and equal protection of laws in our country’s history.

Multiple news sources reported on 05/28/2019 and 09/03/2019 that McConnell said the Republican-controlled Senate would fill an opening seat on the Supreme Court of the United States if there is an opening seat in 2020. This is in stark contrast with McConnell’s complete blockade of the Garland nomination by President Obama. Aside from the obvious hypocrisy and partisan power grab, McConnell’s own words added further evidence to support our lawsuit.

The Redress we are seeking is for the Court to Review and Declare that:

the Defendants’ refusal of confirmation process to a presidential nomination is unconstitutional.
the Defendants shall be held in contempt of the Constitution because they violated their oath to the Constitution.
the same well-established long-standing confirmation process shall be guaranteed for all presidential nominations in the future.

result. Either that or Orange Man's first pardon, but you are talking about New York. I suspect the judge is NOT a RW toady.

This one isn’t close.

Oh... I suppose there could be a judge with an unexpected reaction to a brand new medication who might go nuts... but this doesn’t even make an actionable claim.

There's also one saying that the electoral college is unconstitutional... and one asking the court to force Gorsuch to resign and Garland to be seated.

I'm sure that he would have one trying to force Pelosi to impeach if he weren't so busy redrafting his pleading over and over when he's notified of deficiencies.
