Former Employees of Beaver County Health Care Facility Indicted on Federal Hate Crime Charges Related to Alleged Assaults Against Disabled Residents


PITTSBURGH, PA – Two former residents of Beaver County, Pennsylvania, have been indicted by a federal grand jury in Pittsburgh on federal hate crime charges, United States Attorney Cindy K. Chung announced today.

The twelve-count Indictment unsealed yesterday names Zachary Dinell, 28, formerly of Freedom, Pennsylvania, and Tyler Smith, 31, most recently of New Brighton, Pennsylvania, as defendants.

According to the Indictment, Dinell and Smith were employees of an in-patient health care facility located in New Brighton, Pennsylvania. The Indictment alleges that residents of the facility suffered from a range of severe physical, intellectual, and emotional disabilities, and required assistance with all activities of daily life, including bathing, using the bathroom, oral hygiene, feeding, and dressing. As members of the facility’s Direct Care Staff, Dinell and Smith were responsible for providing this daily assistance to residents.

The Indictment further alleges that from approximately June 2016 to September 2017, Dinell and Smith engaged in a conspiracy to commit hate crimes, and did commit hate crimes, against residents of the facility because of the residents’ actual or perceived disabilities. As part of the conspiracy, the Indictment alleges that Dinell and Smith exchanged text messages in which they expressed their animus toward the disabled residents, shared pictures and videos of residents and attacks, described their attacks, and encouraged each other’s continued abuse of residents. Dinell and Smith allegedly carried out their attacks in a variety of ways, including by punching and kicking residents, jumping on residents, rubbing liquid irritants in their eyes, and by spraying liquid irritants in their eyes and mouths.

Federal Grand Jury Indicts 2 Former Beaver County Healthcare Workers On Hate Crime Charges

PITTSBURGH (KDKA) – A federal grand jury has indicted two former healthcare workers on federal hate crime charges.

The charges are connected to two men who worked at a Beaver County nursing facility that cares for individuals with severe physical and intellectual disabilities.

Zachary Dinell and Tyler Smith were named in four lawsuits in 2019 alleging the abuse and assault for four residents.

Dinell was charged with aggravated assault, neglect of a care-dependent person, endangering the welfare of children, recklessly endangering another person, invasion of privacy, and sexual abuse of a child.

Beaver County Man Charged With Raping, Taking Nude Photos Of Unconscious Woman

FREEDOM (KDKA) – A man is facing charges after allegedly raping and taking nude photos of an unconscious woman in his home.

According to police, the incident happened in a home in the 600 block of Ninth Street in Freedom on June 1.

The victim told police she met the suspect at the Stonewall Golf Course. The two used to work together and reconnected at a golf tournament there last week. The suspect was later identified as 24-year-old Zachary Dinell.

When it started to rain, she got into Dinell’s car and he made her a drink, which she poured out of the window. Dinell convinced the victim to come to his house, where he made another drink. This time, Dinell allegedly pushed the cup toward the victim’s mouth multiple times.

The lawsuits say Beaver County investigators found more than 150 “obscene and disturbing photographs of seven McGuire Memorial residents on Dinell’s phone.” Investigators also said they found “numerous videos” showing the abuse of residents.

The lawsuits allege those videos show one victim being kicked in the face, another being slapped with a plastic toy, Smith jumping on a victim who was lying in bed and another allegedly shows Dinell rubbing “a foreign substance into a resident’s eyes.”

The lawsuit claims another video shows a victim in bed with feces smeared on his chest, face and hands.

According to the lawsuits, one of the victims was just 13-year-old at the time of the alleged abuse. Also, the suits allege the abuse and assault “caused or contributed” to the deaths of two of the victims.

In the summer of 2018, Dinell was accused of raping and taking nude photos of an unconscious woman in his home in Freedom.
