This man is a hero, a giant among men, far braver than I.

(11,087 posts)I'd have ordered Bush and Cheney led away in handcuffs on Inauguration Day, 2009. I'm still disappointed it didn't happen.

(5,113 posts)If you were ordered to commit war crime but the order was not manifestly unlawful, you wouldn't be held responcinble for obeying that order. You are stil obligated to report the crime once you discovered that the order was unlawful.
If I remember correctly, you will not be held responcinble if you were forced to commit a crime, but the obligation to report it as soon as possible is still there.
You can check the link below for some of the rules:
http://www.icrc.org/customary-ihl/eng/docs/v1
Rule 151. Individual Responsibility
Rule 151. Individuals are criminally responsible for war crimes they commit.
Rule 154. Obedience to Superior Orders
Rule 154. Every combatant has a duty to disobey a manifestly unlawful order.
Rule 155. Defence of Superior Orders
Rule 155. Obeying a superior order does not relieve a subordinate of criminal responsibility if the subordinate knew that the act ordered was unlawful or should have known because of the manifestly unlawful nature of the act ordered.
