Pepper Spraying Cop Likely To Receive Workers Compensation

Last edited Mon Aug 19, 2013, 10:22 AM - Edit history (1)

DAVIS, CA - Although the university paid out a total of $1 million to the pepper-sprayed protestors, Pike, who was later fired, claims he was a victim for the way he was treated in the wake of the incident.

A psychiatrist, who was agreed upon as an expert by both UC Davis and Pike's attorney, found Pike suffers from a "moderate" disability and is therefore entitled to workers' compensation benefits, the amount of which is still to be determined, according to the university.

5. They wouldn't qualify since they were not employees.

But I understand your intent. His victims were compensated, though, via the $1 million paid to them by the U. The workers comp law states that benefits must be provided to this cop, if he has a temporary or permanent disability, even if he was at fault for his own injuries.

While difficult to accept, in this case, the "regardless of who is at fault" clause actually helps protect both employees and employers financially, by not expending money on lawyers and court fees in an effort to attribute "fault" or "percentage of fault" to the various parties.

Unless, of course, karma sees fit to deliver some form of justice.

7. It's still part of his compensation, like an employer-paid pension fund

That's part of the compensation.

A pension fund entirely paid by an employer is generally regarded as a defered benefit in lieu of a better salary while employed. Worker's comp is insurance and assessed by risk of the job type, number of employees, location etc. and ONLY payable under one condition: disability.

Very different. ETA: previous employer here.

is one backwardass country and becoming more so everyday. Tea Party? RW in congress fucking up everything. Guns, guns, guns and more guns to be shot by zimmerman types, spell that zimPIG. Getting pepper sprayed while peacefully protesting? What's with this shit. Hell every since Kent State, students take their lives into their hands when peacefully protesting the insane moves by our government. Racism and stupidity rampant in the general population. Black on black crime, white on white crime, wall street crime, corporate crime(BP) as just one example and then mix all that crime up and everyone is at risk. geez what's a sane person to do?
