Supreme Court justice Antonin Scalia’s sudden death last weekend created a hole in the High Court that sets up a major battle between Democrats and Republicans. But even more importantly, it creates an opportunity for several cases already before the Court.

'Can' and 'will' are mutually exclusive verbs. One implies capability/capacity, the other requires some anatomy. If you have to ask the question, you already know the answer.
