The West Virginia Supreme Court in Committee on judicial ethics vs printz held long time failure to enforce a law did not violate the right of a defendant to be prosecuted only with due process of law but I think the real Supremes might disagree. You can’t be convicted of something not written down as against the law, or at least illegal from established legal precedent. That’s part of our constitution. And if a law has never been enforced in hundreds of years it really isn’t part of the law in a practical sense. People should have some kind of warning that something is illegal before they are convicted. That’s how I view the meaning of due process of law in this case. And I would bet the Supremes would see it that way too. Logan Act? Not enforceable.
