Judge orders DOJ to release Trump obstruction memo, says Barr was 'disingenuous'

U.S. District Judge Amy Berman Jackson, in a sharp rebuke of the former attorney general, said the Justice Dept. had obscured “the true purpose of the memorandum."

A federal judge has ruled that former Attorney General William Barr was “disingenuous” about the process behind his decision to issue a memo clearing then-President Trump on obstruction of justice charges.

At issue is a Freedom of Information Act lawsuit seeking, among other things, a Justice Department memo that Barr said helped guide his decision to declare that the evidence described in special counsel Robert Mueller's report on his investigation into Trump did not support a charge of obstruction, even leaving aside the policy against indicting a sitting president.

The DOJ had refused to give the March 24, 2019, memorandum to a government transparency group, saying the document represented the private advice of lawyers — before any formal decision had been made — and was therefore exempt from disclosure.

In a ruling issued this week, U.S. District for the District of Columbia Judge Amy Berman Jackson said the memo should be released because it did not fit the exemption for “deliberative” documents under the law.

In so doing, she called Barr’s credibility into question, and criticized the process under which he quickly issued a summary of the Mueller report that plaintiffs said appeared designed to “create a narrative to counter the special counsel’s findings and cast the President in the most positive light possible.”

And I'm no lawyer, but it doesn't look good for Barr. By saying he was "disingenuous," she seems to be saying he lied. In other words, he hadn't even skimmed the report before announcing it exonerated the former guy - and that was not his job, he was not representing the former guy, he was there to represent this country.

is a dangerous finding from the Judge?

Do you think Garland would send investigators after the former AG over something like this?

Cause I have a hard time seeing anything like that happening, myself.

But I'm a person who is also not a lawyer

I mean you don't expect the top legal person in the country to blatantly lie. And that's what they're calling him out on and investigating. The judge is requesting the paperwork, so the story's not over.

Instead he issued a cryptic letter that Barr's summary did not get everything in the report. Well duh, it was a summary, that hardly adresses the real issue. Mueller should have come fight out and said Barr was MISCHARACTERIZING the conclusions of the report. But he didn't. Mueller failed his country.

leads to acting in a bold and reckless way...

and so far it's worked out for them as only a handful of them has done any time (and many of those got pardons). My prediction for Barr is that he'll continue to happily lead a corrupt and corpulent life safely outside the prison system until he strokes out or has a heart attack...and the same goes for the former guy.

I hope the future proves me wrong.

how huge and singular the Republican party has become a criminal organization with the intent of subverting, not upholding the laws in particular that are necessary for a true democratic republic.

A 40 year crime spree against the very idea of democracy with stacked Courts, voter suppression and deregulation of media.



Beginning with the 80s after Watergate interrupted the original beginnings, 1969, kicked off with Nixon's immediate theft of the War on Poverty funds while leaving the law on the books, which the media then echoed Republicans and called a "failed," anti-poverty program.
