Disobeying a direct order is frowned upon to say the very least. And he's an officer and commander of a ship that can leave port because of him.
Even if a judge rules in his favor it won't turn out well for him in the Navy as he'll always be seen as someone who bucks superior officers. He'll be eased out. It's the Navy's jurisdiction, not that of a local judge.
It reminds me of the Marine officer last year who released a video last year that vent viral. He was relieved of command for behind critical of commanders.
