A grand jury has indicted the suspect in the Buffalo, New York grocery store attack that killed 10 people. CBS News National Correspondent Jericka Duncan was in the courtroom in Buffalo when the judge made the announcement. She spoke with Anne-Marie Green and Vladimir Duthiers on CBS News about what happened in court.

1. Death penalty is apparently an option for prosecutors

Prison is going to be hell for Duncan unless he's sequestered from the general population.

BUFFALO, N.Y. (WKBW) — The suspect in the mass shooting at Tops on Jefferson Avenue is due in court Thursday for a felony hearing. But there are two things that may happen before then, absolving the need for the felony hearing.

"I expect that he'll be indicted, but I also expect that the Department of Justice and the Assistant United States Attorney General Trini Ross will bring federal charges, federal hate crime charges, against the suspect. It carries the death penalty," New York Attorney General Letita James said.

3. THREE lawyers? I wonder who's paying for them

because it isn't this kid and it's probably not his family. Conklin is a small town that's getting smaller, it's lost something like 25% of its population since its heyday.

I hope somebody follows the money on this.

Not surprised by the plea. undoubtedly his lawyers are looking for a plea bargain, although I'm not sure what that would be, 13 counts of simple misdemeanor assault? Good luck with that one.
