Section 3 of the 14th Amendment bars anyone from office who has been found to have “engaged in insurrection" against the United States.

Yes, that includes Donald Trump.

He shouldn't be able to run for re-election.

SANTA FE — A New Mexico judge ordered Otero County Commissioner Couy Griffin be removed from office, effective immediately, ruling that the attack on the Capitol was an insurrection and that Griffin’s participation in it disqualified him under Section 3 of the 14th Amendment. This decision marks the first time since 1869 that a court has disqualified a public official under Section 3, and the first time that any court has ruled the events of January 6, 2021 an insurrection.

Section 3 of the 14th Amendment, also known as the Disqualification Clause, bars any person from holding federal or state office who took an “oath…to support the Constitution of the United States” as an “officer of any State” and then “engaged in insurrection or rebellion” or gave “aid or comfort” to insurrectionists. Griffin, as an Otero County Commissioner since January 2019, took an oath to “support and uphold the Constitution and laws of the State of New Mexico, and the Constitution of the United States.”

“This is a historic win for accountability for the January 6th insurrection and the efforts to disrupt the peaceful transfer of power in the United States. Protecting American democracy means ensuring those who violate their oaths to the Constitution are held responsible,” said CREW President Noah Bookbinder. “This decision makes clear that any current or former public officials who took an oath to defend the U.S. Constitution and then participated in the January 6th insurrection can and will be removed and barred from government service for their actions.”

Under New Mexico law, any private citizen of the state may file a lawsuit to remove a disqualified county official from office. A group of New Mexico residents were represented in this case by Citizens for Responsibility and Ethics in Washington and the New Mexico-based law firms of Freedman Boyd Hollander and Goldberg P.A, Dodd Law Office, LLC, and the Law Office of Amber Fayerberg, LLC, as well as by Cohen Milstein Sellers & Toll PLLC.

“Judge Mathew’s decision is fully supported by the facts and the law and justice achieves a needed measure of accountability,” said Freedman Boyd Hollander and Goldberg P.A Partner Joe Goldberg.

And anyone who swore an oath to support The Constitution when they took office. Thanks for the example! Robert Reich gave an example, too - and obviously this also applies to the chief insurrectionist himself...

Every damn one of them who voted not to accept the Electoral Votes of several States were in on
the insurrection. The Select Committee has touched on this subject that not certifying the votes
on Jan 6th was part of their plan to overthrow the Government. Be nice if we could kick them all
out of Congress with some sort of class action suit all on the same day. That would give us a super
majority in both Houses while Governors were scrambling to replace them. I know I'm dreaming.

Since he's Rep. for the farthest point in the state - NY-1 - and I'm in NY-21, I'd never heard of him before until I started seeing lots of signs for him in my area. I had to look him up and I'm paying attention. So what's up with all the signs I'm seeing?? Do these North Country neighbors support a downstate right wing insurrectionist??

And they keep reelecting Stefanik - who replaced a long time Democratic incumbent who retired - so apparently there are more idiots in my district than I previously knew.

could start with the congress critters who gave the guided tours of the Capitol just before the Jan 6th
attack. Surprised the Committee never touched on them with their public hearings, they have
probably talked about them behind doors.

Who disqualified him from the ballot, but I’m not sure how many would do that. He hasn’t been indicted or convicted of anything yet.

If you tossed a broad net you could remove the most dangerous republicans.They are against democracy. They are seditious because of this. Just like the bitter old south who lost the civil war..

Put the brass knuckles on and remove them all with the 3rd of the 14th!
What they say on thier own videos it is pretty obvious to me they want to take over our country , twist the constitution and end our democracy. Every election denier undermines the constitution.
