My former urologist is a dick! For a couple of years he was pushing a procedure he helped develop.

My research showed a high failure rate with serious side effects. When I tried to discuss my findings with him he lost it and suggested that when I graduated medical school I could challenge him. A couple of months ago I started seeing another urologist who validated my opinion of the previously recommended procedure. My new specialist requested my medical records from the dick. He refused to release them. So I’m now starting from scratch!

this type of offense and my legal fees would far exceed any benefit the records would provide.

The medical board will investigate and the office has to cooperate. So the worst that could happen is you spend 5mins filling out a form and tie up their office for a few hours answering it. Meanwhile at the very least there will be a record of their assholery that will be discoverable by anyone else filing a lawsuit against them.

You might also do a BBB complaint and file another with your insurance company.

Your time is free. Theirs costs money.

More and more people are checking reviews and when you have a lot of people saying they got screwed, people stop knocking at your door. Yelp is the one I use quite a bit.

HIPAA requires medical providers to provide copies of medical records within 30 days of your request. If it will take more than 30 days to meet your request, the medical provider must give you a reason for the delay.

As Historic NY points out, HIPAA, is very clear that you own your medical records by federal law. Here are guidelines for filing a complaint.

feels that Mr. Floyd does have a legal basis to get his medical file, or at least a copy of it. So if a Small Claims court is available, then at the very least, Mr. Floyd could force a legal response from his former doctor. I hope this answers your question.

of his medical record (including court costs, etc.). Once in court, it is possible that Mr. Floyd's case might be decided in his favor.

under a certain amount. They wouldn't have jurisdiction over a patient's demand for his medical records.
