Bar confirms investigation of Horne
Complaint alleges AG twice violated its rules of conduct
PHOENIX - The State Bar of Arizona is investigating Attorney General Tom Horne, adding to the legal woes of the state's top lawyer.
Bar spokesman Rick DeBruhl confirmed that his organization is looking into a complaint the attorney general violated rules governing the conduct of lawyers. If an investigatory committee finds violations, a disciplinary panel could impose sanctions, from a reprimand to disbarment.
DeBruhl said there are two key areas of scrutiny.
One stems from an investigation of Horne by the FBI into allegations that he broke campaign finance laws in his 2010 election by illegally coordinating his efforts with what was supposed to be an independent committee.

DeBruhl said the Bar also is looking into allegations that Horne, driving someone else's car, left the scene after hitting another vehicle.

(33,032 posts)Horne was the president of T.C. Horne & Co., an investment firm he founded in the late 1960s. After the firm went bankrupt in 1970, Horne received a lifetime trading ban from the Securities and Exchange Commission.[19] The 1973 SEC report alleged that as president of T.C. Horne & Co, Horne "among other things, violated the record-keeping, anti-fraud, and broker-dealer net capital provisions of the federal securities laws and filed false financial reports with the commission." Horne stipulated to an SEC finding that he and his firm "willfully aided and abetted" in violations of securities laws.

(31,849 posts)During the AG election, I asked a horne canvasser: "Isn't a big job of the AG, the enforcement of state securities laws ... How will he do that, when he apparently could follow them himself?"

(32,020 posts)Just as there is no requirement to be a lawyer to be appointed to the Supreme Court or be appointed to head the DOJ. However the two alleged violations that the AZ Bar is looking at are not violations that would result in the loss of a license. That penalty is reserved for extreme cases and these would not meet that standard.
