San Diego Sheriff Bill Gore is no longer honoring demands from federal immigration authorities to extend detention in county jails for people suspected of being in the country without authorization.
The change in policy means such inmates will no longer be held for 48 hours beyond their normal release, before they can be turned over for possible deportation.
The change took effect this week, and comes in the wake of a federal court ruling in April. A judge found that the federal holds violate constitutional protections against unreasonable seizures.
Now immigration authorities will need to get a court warrant showing probable cause to detain someone if officials at ICE, or Immigration and Customs Enforcement, suspect the person of being deportable.
