General Assembly Andy Beshear and Gov. Matt Bevin’s attorneys agree Kentucky Retirement Systems’ lawsuit still raises legal questions of executive branch powerWith a Republican-majority General Assembly, lawmakers will most likely codify Gov. Matt Bevin’s executive order abolishing the previous Kentucky Retirement Systems’ board in the upcoming session, but both Attorney General Andy Beshear, his legal team and Bevin’s attorneys agree arguments of constitutional authority and separation-of-power questions should be resolved.
Franklin Circuit Judge Phillip Shepherd listened to oral arguments from Kevin Chlarson, Deputy Attorney General Mitchel Denham and Bevin’s counsel Steve Pitt.
Kevin Chlarson, attorney for ousted board chair Tommy Elliott, argued for final judgment on whether Bevin overstepped his executive power by abolishing the former KRS board and ousting Elliott in April.
Current KRS board member Mary Helen Peter joined the lawsuit along with Elliott.
