Bay County tree service gets second cease-business order from state in 2017

BAY CITY, MI -- Earlier this year, a Bay County tree service was court-ordered to cease business operations. Now, the state has issued yet another order to stop operating after the owner remained defiant in the press and continued taking jobs. ... In late December, the Michigan Department of Licensing and Regulatory Affairs directed the Michigan Occupational Safety and Health Administration to execute its second cease-operations order of 2017 against Sunset Tree Service & Landscaping LLC for "continuing to operate without abating hazards on the jobsite."

Days after the judge's ruling, Sunset owner Chad Nichols told MLive-The Bay City Times he planned to keep taking jobs, only without using the Bandit Chipper. LARA officials "strongly advised" Nichols against taking more jobs until the issues were resolved. ... Nichols, speaking again to MLive on Dec. 27, said the issues MIOSHA listed in their most recent order have already been remedied. ... "I got more papers because I won the last battle, or semi-won it," he said. "The last order was to have the guys trained in safety and the chipper be up to code. The safety issues are all complied with. The chipper's not in use. We don't even have it anymore."
He said MIOSHA and LARA's interactions with his business amounts to harassment. ... "These just went back in the books to try to find more stuff," Nichols continued. "They don't like me. They're doing everything they can to make it miserable. Nobody stands up to them." ... Despite the order, Nichols said he plans to continue operating his business. ... "I don't stop working. Never have, never will. There's no ramifications for 'What if we do work?' They can send the state police to shut us down and we'll go right back to work."
Even before this year's dealings, Sunset had a long history of safety violations. From 2011 to 2016, MIOSHA issued the company 48 citations totaling $150,000 in initial penalties.
