Follow-up: Parents must pay $30,441 for getting rid of son's porn cache

GRAND HAVEN, Mich. (AP) — A judge has ordered a western Michigan couple to pay $30,441 to their son for getting rid of his pornography collection.

U.S. District Judge Paul Maloney’s decision this week came eight months after David Werking, 43, won a lawsuit against his parents.

He said they had no right to throw out his collection of films, magazines and other items. Werking had lived at their Grand Haven home for 10 months after a divorce before moving to Muncie, Indiana.

The judge followed the value set by an expert, MLive.com reported. Werking’s parents also must pay $14,500 to their son’s attorney.

It has to be back-breaking labor to move such a large porn collection around. I guess the positive side of the pandemic is that I won't be expected to shake hands with him.

Like it or not, they destroyed a collection that had a monetary value.

That being said, the man who chose to pursue a lawsuit against his parents for that destruction - despite the law being on his side - will probably never see another penny from his parents, and rightfully so.

I am currently the owner of a mortgage-free house worth over $850,000. If my son sued me for any reason, he'd get a rude awakening when my will was read leaving everything to his sister.

Actions have consequences.

I’m sure he was disappointed, but to sue his parents? I’d never. I wonder if the parents can pay him one dollar a month until paid off. Lol.

However, that makes me wonder why he didn't try to sell part of his collection since his finances were so tight that he had to move back in with his parents.

Follow up questions include whether he disclosed to his parents that he was moving such a large porn collection into his home, and if he didn't disclose that information how did his parents learn of the porn stash. Also, what responsibility do the parents have towards maintaining his property after he moved out. It certainly does not appear that the parents gave permission for his son to have the porn stash at home; therefore, it doesn't seem reasonable for the man to expect his parents to provide storage after he left. At some point the porn becomes abandoned property and the parents have every right to remove that property from their household since they find it offensive. If the porn collection is one of his prized possessions and since he had to have at least some clue that his parents wouldn't approve, then he should have rented storage space to keep his collection.

From a personal perspective, I already knew that if I had brought a stash of porn into my parent's house that my father would have tossed it immediately. I view bringing the porn stash into the house almost as disrespectful as bringing drugs or excessive amounts of liquor into the home.

I hope that the parents presented their son with an invoice for services rendered while he lived at home.
