Dismissal of lawyer's DUI charge slammed by Mississippi Public Safety Commissioner

TUPELO, Miss. — Mississippi's public safety commissioner is slamming a judge's ruling dismissing a drunken driving charge against a city attorney.

Commissioner Marshall Fisher, in a statement released Monday, says the dismissal of the charge against Tupelo city attorney Ben Logan "is nothing more than local politics getting the end result they wanted by blaming a state agency."

Lee County Justice Court Judge Chuck Hopkins told the Northeast Mississippi Daily Journal that he dismissed the charge as unconstitutional, finding the DUI checkpoint hadn't been approved by a supervisor.

Hopkins on July 11 dismissed a DUI refusal charge against Logan.

Logan was charged in December with refusing a DUI breathalyzer test.
