By BENJAMIN WEISER
A federal judge in Manhattan indicated on Tuesday that he was unlikely to approve a defense lawyers request that Mayor Michael R. Bloomberg be compelled to appear and testify as a defense witness in a fraud trial starting next month.
The mayor had been subpoenaed by a lawyer for Mark Mazer, the lead defendant in what prosecutors have called a massive and elaborate scheme to defraud New York City through an automated payroll project called CityTime, which they said involved more than $600 million in city money and more than $40 million in kickbacks.
The city had sought to quash the subpoena, arguing that the mayors role with respect to CityTime has little, if anything, to do with the charges at issue in this case. Compelling the sitting mayor to testify, the city argued, will simply divert attention from the real issues and risk turning the mayors appearance at trial into a sideshow.
On Tuesday, Judge George B. Daniels of Federal District Court made it clear he was not yet persuaded that Mr. Bloombergs testimony was relevant or necessary.

He made sure Manhattan was clear but my street was not cleared for 4 days.
He came to a bar down the block from me the day after the storm and people brought their shovels to complain to him. He brought a snow plow to get through the streets.

(71,265 posts)He kept people in jail 24 hours so they could not protest again. The city had to pat lawsuits out for that. He should have had to pay.
