Allegheny County Council introduced legislation Tuesday that would prohibit the county from cooperating with federal immigration enforcement agencies as protests over the fatal shootings of two U.S. citizens in Minneapolis have continued across the region.
The bill sponsored by five County Council members, including at-large council members Bethany Hallam and Alex Rose prohibits the county from allowing agents from U.S. Immigration and Customs Enforcement or U.S. Customs and Border Protection to access anyone detained by the county without a judicial warrant.
This would create an extra barrier for the federal government because ICE does not need judicial warrants a judges order authorizing a search, seizure, or arrest to detain individuals because those suspected of being in the country without authorization is a civil violation, not a criminal offense.
Instead, immigration arrests are authorized by administrative warrants, which the county would not honor under the new legislation.
The bill proposed by Allegheny County Council also bars the county from allowing ICE or CBP from using its facilities, equipment, or data bases and forbids county employees from communicating with ICE or CBP about any individuals the federal agencies may inquire about.
