Paxton must devote time to avoiding prison

The criminal charges against Paxton are serious, and he knows it. Preparing for appearances in court and participating in his own defense will require hundreds of hours of Paxton’s time. Texas Attorney General is a full-time job paying him a full-time salary of $150,000 per year. Ken Paxton can’t enforce the law at the very same time that it is being enforced against him.

Ken Paxton is being prosecuted for violating a Texas state securities law that he voted for as a legislator and is sworn to enforce as AG. Yet, Paxton is arguing in court that the statute does not apply to him and is superseded by federal law. As long as Paxton is acting as AG, there is an inherent conflict between his responsibility to enforce the law and his desperate need to avoid its enforcement against himself.
