The judge could keep the case in his court a move that would allow Ethan Couch to go free on parole after serving time in a detention facility until his 19th birthday in April, Wilson said.
The juvenile judge could hand his file to the adult court system, in which a judge could sentence him up to 120 days in jail. In this scenario, an adult court judge would supervise him for the rest of his probation.
But, if he violates any terms while on adult probation, he could be sent to jail for up to 40 years.

1) Wouldn't have survived the arrest.
2) Would have gone to prison the first time around.
3) Would not have survived the re-arrest after violating probation.
4) Would be going to prison forever at this point.

(6,241 posts)that same judge, Jean Boyd, had a 16 year old AA in her court that killed one person in a DUI in 2004. This kid, Eric Miller, got 20 years in prison.

But Ethan, who killed 4 people, gets probation. Totally fair.

(1,832 posts)Anderson said an arrest warrant was being issued for Couch's mother, Tonya Couch, on charges of hindering an apprehension, a third-degree felony that carries a sentence of two to 10 years in prison. Tarrant County District Attorney Sharen Wilson said that at a hearing next month she plans to ask a judge to transfer Ethan Couch's case to adult court.
Couch would then face up to 120 days in an adult jail, followed by 10-year probation. If he violates probation, he could face up to 10 years in prison per death, Wilson said.
If the judge declines to transfer Couch to adult court, Wilson will ask that his probation be revoked, in which case he could be held in a juvenile facility until his sentence expires when he turns 19 next April
