Paxton sues FDA over seizure of imported lethal injection drugs
The Texas Department of Criminal Justice on Tuesday sued the federal government to get back about 1,000 vials of a lethal injection drug seized at a Houston airport about a year and a half ago.
Texas Attorney General Ken Paxtons office drafted and will lead the litigation against the U.S. Food and Drug Administration. The FDA seized the drug in July 2015 and has held it ever since to determine if its importation violated drug regulations. The vials were imported from India.
My office will not allow the FDA to sit on its hands and thereby impair Texas responsibility to carry out its law enforcement duties, Paxton said in a statement Tuesday, adding that the FDAs action represented either gross incompetence or willful obstruction.
The suit calls for the FDA to make a definite ruling on whether the federal agency will turn over the shipment of the drug sodium thiopental back to the state agency, which oversees Texas prisons and executions.
