Court records show Texas Tech shooter completed pretrial diversion program for 2016 pot bust
Court records show Hollis Daniels III, the Texas Tech freshman charged in the fatal shooting of a university police officer, was arrested last year on campus for a misdemeanor drug charge, which was rejected after he completed a pretrial diversion program.
Daniels was arrested Sept. 23, 2016 for a class B misdemeanor count of possession of less than 2 ounces of marijuana. Class B misdemeanors carry a punishment of up to 6 months in jail.
However, Daniels qualified for a pretrial diversion exchange program at the Lubbock County District Attorneys Office typically offered to youthful, low-level offenders with little to no criminal history. Successful completion of the program results in the case being rejected by the DAs office. Court records show Daniels completed the program in December.
While theyre doing this stuff on the exchange program the case is still remains unfiled and pending in our office, said prosecutor Tom Brummett, who did not comment specifically on Daniels case.
