Article 16 - GENERAL PROVISIONS

Section 65 - TERMS OF OFFICE; AUTOMATIC RESIGNATION

(a) This section applies to the following offices: District Clerks; County Clerks; County Judges; Judges of County Courts at Law, County Criminal Courts, County Probate Courts and County Domestic Relations Courts; County Treasurers; Criminal District Attorneys; County Surveyors; Inspectors of Hides and Animals; County Commissioners; Justices of the Peace; Sheriffs; Assessors and Collectors of Taxes; District Attorneys; County Attorneys; Public Weighers; and Constables.

(b) If any of the officers named herein shall announce their candidacy, or shall in fact become a candidate, in any General, Special or Primary Election, for any office of profit or trust under the laws of this State or the United States other than the office then held, at any time when the unexpired term of the office then held shall exceed one (1) year, such announcement or such candidacy shall constitute an automatic resignation of the office then held, and the vacancy thereby created shall be filled pursuant to law in the same manner as other vacancies for such office are filled. (Added Nov. 2, 1954; amended Nov. 4, 1958, and Nov. 2, 1999.)

Louie does not have to resign

I don't think he can run for both AG and congress on the same ballot...

If he runs for AG, I don't think he can run for congress.

I'm sure he will lose the AG primary, but I guess he could run for congress as an independent.

I really think this is nothing more than a fundraising scam by Gohmert.

He said he will run for AG and won't run for congress if gets $1 million by Nov 19th.

Gohmert said he would be "all in" if he can collect $1 million in contributions by the end of the day on Nov. 19. If he does not, he added, he would run for reelection to his current seat in Texas' 1st Congressional District.

Gohmert is asking supporters to help him raise $1 million by Nov. 19 before he officially jumps in the race, according to a website that went live Tuesday. The nine-term congressman, a member of the conservative House Freedom Caucus, has not raised that much money since 2006.

“If the money’s not there, then I will file again to run for Congress, and I’ll fight there, but I feel in my heart I can do so much if I’m attorney general to get us back on track,” Gohmert said in Tyler, as the room broke out in applause.

The two-term incumbent Ken Paxton already faces three high-profile primary opponents: Texas Land Commissioner George P. Bush, former Texas Supreme Court Justice Eva Guzman and state Rep. Matt Krause, R-Fort Worth.

“He barely got over 50 percent of the vote last time in the general election,” Gohmert said. “With what’s coming, I see a real opportunity for a Democrat to take over.”

Gohmert highlighted immigration and concerns over how race is being taught in Texas schools as key issues on which Paxton is falling short and that he would tackle as attorney general, although he did not elaborate on what he’d do differently.
