Woodard moves to drop Kessler as a client in permit case

After conceding defeat in court Tuesday, effectively ending the notion of another organized Unite the Right rally in downtown Charlottesville on the weekend of Aug. 12, attorney Elmer Woodard has moved to drop Jason Kessler as his client. ... In a motion filed Wednesday, Woodard says Kessler “has not met his financial responsibilities,” rendering representation “unreasonably difficult.”

While his federal lawsuit against the city remains open after it denied his permit application for a sequel to last year’s deadly white nationalist rally — with a four-day trial scheduled for April 8 to 12 — the case will not be able to go forward if Kessler cannot find someone qualified to replace Woodard.

“I can’t be on the team if there’s no local counsel,” said James Kolenich, an Ohio-based attorney representing Kessler. “I’m not a Virginia-licensed attorney.”

The brief hearing on Kessler’s motion to ask the court to make the city give him a permit for a rally in the city next month ended abruptly after Kessler and Kolenich arrived late to the hearing and then requested to withdraw the motion.
