SCOTUS

Here's an idea. If Democrats take the Senate also in Midterms, whoever is elected head of Senate Democrats and I hope it isn't Schumer, must not allow any vacant SCOTUS seat to be filled until there is a Democrat president. If McConnell can do it, so can Democrats if they have the guts to do it. I worry about Schumer being the leader. He's not really a good fighter and caves too easily.

1. I agree. Or, expand the court if the Dems win the 2028 election to one justice per district.

They won't officially be in charge until Jan 2027...so, I think the Republicans could add Republican MAGA Justices before Jan. 2027...

If Dems retake the senate in November, I guarantee that either Clarence, Sammy or both will immediately announce their retirements, so Trump can fill their seats before January.

the court as soon as they have that opportunity (2029?), then our party will be essentially defeated for decades. … Right now I’m kind of feeling like that wouldn’t surprise me either.

Support for Expanding the court, and killing the filibuster to do so, must be the litmus test for all Dem senate hopefuls.

He would fill it BEFORE the midterms and if that happens, guaranteed that Thune would do his finest Turtle impression and shove whoever was nominated through in a month or less.

That is how Amy Coney Barrett got in - nominated a month BEFORE the 2020 election (in October 2020) and sworn in a couple weeks before election day (and we did in fact win the Senate after getting 2 seats in GA after run-offs in January 2021).

While Senate Democrats tried to slow down the confirmation process of Trump's third Supreme Court nominee with various procedural maneuvers, the fact that Republicans control the Senate has always meant a Barrett confirmation was all but promised.

decides to act on your suggestion, they can NEVER go on recess until the end of the 120th Congress.

The instant they recess, Trump will slam in as many justices as he can at every level. While their positions are limited until the end of their next session, they will be in place which makes removing them more of a challenge and the possibility that they can look "reasonable" enough to gather enough sympathy votes to be confirmed before that happens.

That was after Shrub jammed Bolton in as the U.S. Ambassador to the U.N. as a "Recess Appointment" (which happened in 2005).
