Djokovic could have inspired anti-vax Australians, court says

20 January 2022

An Australian court has said it was reasonable to be concerned that Novak Djokovic might have inspired anti-vaccine sentiment, and revoke his visa.

The tennis star had been preparing for the Australian Open when the immigration minister cancelled his visa on "health and good order" grounds.

Laying out its reasons for backing that decision, the court said Djokovic's opposition to vaccines was well-known.

"An iconic world tennis star may influence people of all ages," it said.

In its formal written decision, it found that Djokovic could encourage "especially the young and the impressionable, to emulate him".

Judges didn’t consider ‘wisdom’ of deporting Novak Djokovic

By JOHN PYE and ROD McGUIRK
January 20, 2022

MELBOURNE, Australia (AP) — Three Australian Federal Court judges on Thursday revealed their reasons for backing a government order to deport tennis star Novak Djokovic, explaining they did not consider the “merits or wisdom of the decision.”

The judges on Sunday unanimously endorsed Immigration Minister Alex Hawke’s decision to deport the 34-year-old Serb following an urgent court challenge on the eve of what was to be Djokovic’s first match in defense of his Australian Open title. Djokovic accepted the verdict and flew from Melbourne to the United Arab Emirates hours later.

Chief Justice James Allsop and Justices James Besanko and David O’Callaghan on Thursday released a 27-page explanation of why they rejected Djokovic’s challenge.

“The court does not consider the merits or wisdom of the decision,” the judges said. “The task of the court is to rule upon the lawfulness or legality of the decision.”

1. Nope not vaxxed
2. Yes -- he lied twice on the application

Should be a simple equation
1. Vaxxed and truth -- come on in, welcome to Australia
2. Vaxxed and lied -- get out. Don't come back
3. Unvaxxed and truth -- Get out.
4. Unvaxxed and lied. Get out . Don't come back. and oh yeah, you signed that it was OK to prosecute you for lying on this form so here is a giant fine for causing all this trouble and you are banned for at least 3 years.

Should have been a pretty simple flow chart.
