Righting the wrong

Op-ed: Release of Palestinian prisoners justified in light of violent Israeli occupation

If we were living in a civilized country that does not have a belligerent and oppressive regime, where the justice system treats everyone equally, then I would be opposed to the release of Palestinian prisoners – with or without blood on their hands.

However, since we live under circumstances that are the complete opposite from those described above, when beneath us a nation is suffering under the continuous violent occupation, when the military and civilian justice systems blatantly discriminate between Jews and Arabs (out of 800 cases involving Palestinian minors, only in one was the Palestinian exonerated) – in light of all this, I support any release of Palestinian prisoners.

Since faulty evidence that would not be admissible in any civilian court does not stand in the way of verdicts - I support the release of Palestinian prisoners.

In a country where a senior minister can still keep his job after boasting that he has killed Palestinians and proudly waving his hands that are stained with the blood of his neighbors, where a killer of Jews is justifiably hunted down until he is caught while killers of Palestinians can escape punishment - in such a country I consider the early release of Palestinian prisoners on the occasion of the resumption of peace negotiations as righting a wrong that is greater than the injustice of their release.

Salah Ibrahim Ahmed Mugdad, who was arrested in June 1993 for the murder of Israel Tenenbaum, a 72-year-old security guard at the Sirens Hotel in Netanya. The Fatah member struck Tenenbaum on the head with an iron bar and stole a television set from the hotel.

Mustafa Othman al-Haj, who was arrested in June 1989 for the murder of 48-year-old Steven Frederick Rosenfeld. Rosenfeld had been hiking in the hills near Ariel and was stabbed with his own knife by a group of shepherds, who hid his body.

Salameh Abdallah Musleh, who was charged in October 1993 with the murder of Reuven David two years earlier. David, 59, owned a Petah Tikva grocery store. He was beaten and robbed by Musleh and an accomplice.

Atiyeh Salem Musa, who, along with an accomplice, used an ax to murder a Jewish co-worker, 67-year-old Isaac Rotenberg, during Passover 1994. The murder took place while Rotenberg was hunched on his knees fixing a floor at his place of employment in Petah Tikva. He was struck on the back of his neck, dying two days later.

Salah Mahmoud Mukled, who was arrested in July 1993 for the stabbing death in a Gush Katif greenhouse of Yeshayahu Deutsch, his Jewish employer, and the attempted murder of another local resident.

Yigal Sarna is a left wing secular sabra , born in Tel Aviv in 1952.
He received the IBM Prize for Tolerance for a series of articles about Iranian political refugees in an Israeli prison.

He was a tank commander during the 1973 war and was one of the founding members of Peace Now.

I am against the death penalty except in cases where guilt is beyond any doubt for heinous crimes like the cold blooded murder of children, serial killers, mass murderers and terrorist murderers. For example BTK, Dahmer, Saddam, Kuntar and the guy who shot all those kids at the school are all deserving examples of those I would not have any problem with being executed.

The assassin, a religious Zionist named Yigal Amir, strenuously opposed Rabin's peace initiative and particularly the signing of the Oslo Accords.
