"Against God's Will": Gay Man Sues NJ Hospital For Being Denied HIV Meds

New Jersey gay man Joao Simoes is suing his hospital after an on-staff doctor refused him his HIV medications. Dr. Susan Borga* allegedly later told his private physician what the patient had done to become infected was "against God's will."

When the hospital finally permitted Simoes to call his personal physician on the third day of his stay, he learned that the doctor had already spoken with Borga about Simoes' medication, according to the complaint. Borga allegedly responded: "You must be gay, too, if you're his doctor." "Additionally, apparently realizing that plaintiff's doctor had an accent, Dr. Borga exclaimed, 'What, do you need a translator?' to which plaintiff's doctor had again responded that Dr. Borga needed to give plaintiff his HIV medication," the complaint states. "Dr. Borga responded to plaintiff's doctor by stating, 'This is what he gets for going against God's will,' and hung up the phone on plaintiff's doctor."

The hospital also initially refused to allow the patient's sister to visit him. She was finally permitted to bring him his medications after he'd missed five doses. Missing doses of HIV medication can cause the patient to become resistant to the drugs.

So, now doctor's don't try to save your life if they don't approve of why you are sick.

2. It's part of the new conscience clause...

Something we had talked about a while back when they were saying doctors shouldn't have to give out the morning after pill. I asked when it would become that doctors did not have to treat patients they thought 'deserved it'.

3. Is it a crime to neglect a sick patient?

If not, it should be. That "doctor" belongs in prison.

4. At the very least, this is malpractice, IMO. Losing her license

can come after the authorities open an investigation.

I hope the patient gets a huge chunk of change in the settlement... So that he never has to worry about medical bills again.

6. Screw just a lawsuit, Borga should permanently loose her license to practice.

Medical malpractice lawsuit + board inquiry revoking her license permanently + civil suit for breaking HIPPA laws + Criminal charges as this person's (I refuse to call her a Dr.) actions have the potential to kill a patient under her care (even if in the long run) at worst, and has a high potential to cause severe illness and additional complications to a patient under her care at the very least.

I consider myself a peaceful, and loving man. But this kind of crap makes me wish this woman, someday, receives the same kind of care she gave Joao... where she's denied medication needed to keep her healthy and alive.
