Judge Roy Moore has urged fellow judges not to perform the weddings, but although a few may listen, it is not expected that all will follow his lead.

(60,010 posts)It will be illegal to not marry gays, so they just did what has been done here so often...
when the movie theater burned in the early 60's, they simply did not replace it.
Solved that Equal Rights problem, don'tcha know.
Same with public swimming pool. They moved it out of the city park and onto country club grounds. Gotta be a member to swim.
Or friends of a member.
At some point there was a pool put in the black community, actually.
But no "mixed" swimming.
So, yeah..legally the Probate Judge does not "have to" perform marriages. People can still get married in a church, as most of them do.
Last year there were 89 courthouse weddings.
Legally marriage licenses have to be written at the courthouse.
So far 5 county judges have gone on record stating they will not preform marriages anymore.

Roy Moore and other judges like him can go to hell.

(60,010 posts)Alabama Chief Justice Roy Moore late Sunday ordered all probate judges and employees in Alabama to follow existing state law and not issue or recognize same-sex marriages.
The order from Moore outlines his role as the state's chief judicial officer and says that he is empowered to block any move that will bring chaos and confusion into the system, regardless of federal court orders.

AND Alabama Gov. Robert Bentley and Attorney General Luther Strange both have vowed to continue fighting gay marriage in the courts.
