Ten days after a New York county banned unvaccinated children from public places in an effort to stem the rise of measles cases, a state judge put the injunction on hold.
Children are hereby permitted to return to their respective schools forthwith and otherwise to assemble in public places, Judge Rolf Thorsen wrote in his Friday decision.
The controversial ban, announced by a spokesman for Rockland County Executive Ed Day, was an effort to address an outbreak in Rockland County, where 167 confirmed cases of measles had been reported as of Friday.
Officials in the county declared a state of emergency, as Lindsey Bever reported in The Washington Post last week, announcing that the ban would remain in place for 30 days or until unvaccinated minors receive the MMR vaccine to protect them against measles, mumps and rubella. Unvaccinated minors, official said, would not be permitted in enclosed places like churches, schools and shopping centers.

Thorsens decision, Reiss said, rested on the question of whether the outbreak was an emergency. With an outbreak of such a highly contagious virus, she said, There is a reasonable argument that it is an emergency.

(37,449 posts)meanwhile the cases rise daily, including the maternity wing of a hospital. Apparently the Judge feel that the needs of a few outweighs the health & safety of the many.

(25,857 posts)people are a small enough percentage of the population, that no one will really notice if they start dying in large numbers. Plus, I'm guessing for the most part many of the immune compromised are sufficiently savvy and careful that they aren't often around those who don't vaccinate. Also, if the immune compromised either had the childhood diseases in their youth, or were vaccinated themselves, their risk isn't as bad as it might be.
Whereas unvaccinated kids who get measles or whatever are more or less grouped together in schools, and so when they get sick it's very noticeable.
Religious objections to vaccinations should be eliminated. There are kids who cannot be vaccinated for medical reasons, but if everyone else is, they'll be reasonably safe.
