defensive shooting maybe...Another tough call

Now for one not so easy to judge the righteousness of.

TURLOCK — The shooting death of a man reportedly caught trespassing Tuesday morning remains under investigation as his family expresses outrage over his death.

homeowner Robin Boyer. He told police he had caught the man trespassing on his property and stealing his possessions. An altercation allegedly ensued and Boyer shot Pacheco in the head. His body was found on the edge of a sweet potato field

Tough call, respond and try and preserve your property? Or stay out of sight, call, watch, and hope?

Holding a firearm on someone and hoping they don't attack or try and flee seems a little difficult.

are missing. Personally, if they are outside getting stuff, I would just call the cops. But then if it is junk that I was going to haul away anyway, I wouldn't even do that. If they try to kick in the door, things change dramatically.

normally you don't haul the body off to a sweet potato field.

on details. We don't know that the body was moved. If we are to believe the locals commenting in the newspaper website, the dead guy was stealing to support his meth habit. That does not mean he necessarily deserved to get shot.

Its quite possible he got shot, and ran away, before dying while the body was found.

Given the fact that the guy who was shot had been arrested for grand theft, and meth, I have a tough time believing that he would never hurt anybody.

I live near Turlock, this didn't surprise me about the sweet potato field.

We have a lot of cranksters in the central valley, they are squirly.

a thief. Arm yourself, sure, but phone police and concentrate on a good description of suspect, things taken, car, etc.

I'm not going to confront anyone outside the home....I may yell at them but I'm not going to try and "detain" them what so ever. Most likely I'd call 911 and keep an eye on them, if they were to leave before the police show up I'd do what I can to ID and determine what they're driving or the direction they traveled.

though going out to confront an intruder is a good idea in extremely rare situations

There are lots of reasons why it is a very bad idea to go outside to confront a thief.

1. You may lose the fight and end up dead.

2. You may end up shooting and not have a genuine self-defense case. Go to prison for long time.

3. You may end up shooting, get off on self-defense, and feel terrible about it the rest of your own life.

4. Friends and family of the dead guy may come hunting you for revenge.

That's four fast ones. I am sure there are other reasons.

Now if he breaks into the house, then it is open season. Shoot, with no warnings.

shooting someone you did not intend to shoot or was not involved with whatever nefarious activity that may or may not be happening on your property.

Where are the anti-RKBA folks now who seem to think all gun-rights supporters are bloodthirsty and can't wait to shoot someone?
