(60,567 posts)Because the law doesn't allow non-(federal firearm) licensees to use the National Instant Check System, there is no legally defensible way for them to perform a background check on buyers of used firearms even if checks on that kind of transaction were required.
Checks could be implemented, but the Brady Campaign doesn't have any practical plan for making that happen. Their purpose in creating this video is to appeal to emotions of people who are ignorant of the law.

Yes, I believe that NICS should be made available to the general public, with some simple safeguards to prevent it from being used for any purpose other than a firearm transfer.
Having a legally defensible way to check the background of a gun buyer available also means that people who don't use NICS and sell to someone who turns out to have been prohibited from owning a firearm could be held criminally liable for the transaction.
Under the present system, all a seller has to say is "I had no way of knowing the person was a convicted felon (or whatever.)"

(17,502 posts)legally, although it would be wise. What state was this? Some states and some gun show promoters do have a designated FFL do the checks, then give a wrist band for those who pass. There are a lot of FFLs at gun shows. Have an off duty cop, which they hire for security, use their local system. Or set up national op out system where a NICS code would be put on your DL or state ID.

(5,412 posts)In every state I've lived in, I can post an ad in the classifieds, meet someone in a gas station parking lot, and exchange cash for a firearm, no questions asked.
I did this just a month ago.
If I wanted, I could have requested that the fellow meet me at a gun store, and have him pay $25-$50 extra dollars for an FFL background check, but who wants that extra expense or government tracking?
An easy way around this problem is universal opt-out licensing. Give everyone who applies for a state-issued ID a Firearm Ownership License unless they opt out of the NICS check.
Then require a recording of the license information during any private firearm sale, with steep penalties for firearms recovered from crimes that are traced back to sellers without the records.
Cuts off the easy sale of firearms to criminals, preserves anonymous firearm ownership, and allows for direct mail order of firearms again. It's a win for everyone.

A bit more on topic. I sold a gun this week to a private individual. He showed me his CCW license, which was more than I needed to see, but even if he only showed me his drivers license, I would have been fine with that.
