EVERETT, Wash. The Navy says the commanding officer of Naval Station Everett has been reassigned during a military investigation of a sexual assault allegation.
Navy spokeswoman Sheila Murray said Monday that an Article 32 hearing planned for Capt. James Duke Jr. is similar to a civilian grand jury proceeding.
The Daily Herald of Everett (
http://is.gd/ZY7QWF ) reports that the allegation was initially reported to Lake Stevens, Washington, police in January. Lake Stevens police Cmdr. Dennis Taylor says a woman told police that the 48-year-old man sexually assaulted her after she turned down his request for sex.
Through his lawyer, Duke said Monday that he is innocent and is the "target of a malicious and false allegation." Everett lawyer Anna Goykhman says the accusation was made in retaliation for Duke's decision to end a relationship.
