After marijuana charges, questions on sovereignty emerge
The Flandreau Santee Sioux had an understanding with the federal government: the tribe could grow and sell marijuana so long as it kept it on the reservation and out of the hands of minors and criminals.
It didn't have a deal with Marty Jackley.
The South Dakota attorney general this week brought criminal charges against two Colorado consultants hired by the tribe to help set up a marijuana operation on its reservation south of Brookings.
Jackley said a 150-year-old U.S. Supreme Court decision gives him power to file the charges regardless of the fact the Flandreau Santee Sioux tribe voted last year to legalize marijuana on its reservation.
