2016 Postmortem
Related: About this forumDoes this Sanders Facebook Post's Image Seem Odd to You?
Here's an image that's posted on Bernie Sanders' Facebook page. Notice the campaign logo superimposed on the photo. You'll find a link to the page itself below the photo. This bothers me a lot. Placing a logo on a Reuters news photo seems over the top to me, for some reason. It implies permission and approval. I doubt that any such permission or approval was granted.

What a scandal ... what's next? Is there some secret investigation underway that proves Bernie called kittens cute?
Jesus Hillary supporters are such petty little cry babies.

It's a quote that Sanders agrees with, from a public person whom he admires.
Sanders has been very careful not to imply that Pope Francis endorses him.

Other than doing volunteer work for the respective campaigns, I don't think any of us can speak for either campaigns in an official way.

(5,279 posts)Outrage here at DU isn't indicative of an actual scandal.
While I do not agree with MM as to the best choice in possible Democratic candidates, I do respect his opinions on 99% of all things Democratic and his calls to dial back on internal conflicts.
pat_k
(9,313 posts)I didn't mean to feed into "scandal" -- just wanted to point out that commercial use of a stock photo isn't an out of the ordinary thing.
pat_k
(9,313 posts)There are plenty of stock images of the pope on shutterstock. See below.
Reuters licenses photos for commercial use too.

(9,313 posts)... and the screen often has the logo of the entity sponsoring the training. These courses go through extensive legal review.
I just don't see the problem, but I'm sure you'll be hearing from the vatican soon. Keep us posted.
DrDan
(20,411 posts)An entity sponsoring training would be a completely different circumstance, I would think.
But I am no lawyer.
pat_k
(9,313 posts)I imagine that some of the people in the images we use wouldn't be thrilled about being related to Pfizer (yeah, last training I did was for "the dark side" , but I don't think they'd have grounds to object once the photo has been put out there for commercial use.
But, we don't tend to use public figures. You're probably right about the law not being black and white on the question of what constitutes misleading use of a photo of a public figure sold for commercial use. I'm not a lawyer either (although I played one in an 8 year long pro se case against our securitized mortgage trustee).
It really wasn't my intention to be snarky. I am interested in finding out if you hear anything back.
Karma13612
(4,552 posts)the photo gives proper credit to the photographer in the lower RT corner, and further, that the Sanders campaign credited the Pope for his quote.
I am optimistic that it is all good....
You seem to have had some interesting legal experiences thru work.
I love the law, but don't 'practice it' in my daily life or work. I am always disappointed when I am called for Jury duty and then get released without serving. I would love to serve, but with my luck it would either be something very boring, or something involving rape or child abuse, both of which I wouldn't be able to stomach.
Anyway, I hold out hope that Bernie is in the clear on this FB posting.
DrDan
(20,411 posts)I will do so tomorrow
pat_k
(9,313 posts)Karma13612
(4,552 posts)I would find it hard to believe that the Sanders campaign is going about grabbing photos and quotes and creating FB postings using ill-gotten sources.
Last I knew, in this country, our actions are considered innocent until proven to be criminal.
If Sanders campaign overstepped, they will hear about it in short order, I'm sure.
lumberjack_jeff
(33,224 posts)I only use images that illustrate relationships that really do exist.
JimDandy
(7,318 posts)not the other way around. To make the interpretation you have, that the Pope is endorsing Sanders, it would have to be a photo of Sanders with the Pope's papal stamp on it
DrDan
(20,411 posts)still seems a bit presumptuous.

(9,522 posts)I guess if I was given to passive-aggressive faux outrage I would see something else.
pat_k
(9,313 posts)... or licensing of photos by Reuters, seems to have been lost in the feigned outrage.
If that image hadn't been selected, they could have gone with any of these from shutterstock. Or hundreds of others from other sources.

(30,811 posts)As though the Bernie campaign were trying to hang onto the coattails of a popular pope.
If it were a picture of Sanders himself, with the Pope's quote underneath it, it would seem more appropriate, as though Bernie's own philosophy was bolstered by the Pope's words.
No big deal though. It's certainly not an indictment of Bernie in any way, and probably is a result of someone in his campaign being just a little tone deaf.
