I talked to some friends about the argument. There was some hope that it would be reversed on standing grounds 5-3, but the 5th vote was Roberts and they said he was fairly aggressive in questioning counsel for the petitioners today.
A 4-4 would not be good because the 5th Circuit ruled against the administration and that decision would stand. It would be controlling only in the states in the 5th Circuit but one of them is Texas where it would have a huge negative impact.
Let's hope for the best.

(58,785 posts)but hardly a surprise that the judicial circuit that includes Texas would have ruled against Washington.
So, we wait to see how Justice Roberts might go.
It seems to me that that "huge negative impact" would be felt squarely by the GOP in 2016, not just those unfortunate 5 million whose homes are in America. So, perhaps Texas and others would hold off on deportations. Otoh, as Barney Frank's bump sticker used to say, "...but those people are crazy."
