2016 Postmortem
Related: About this forumAny constitutional experts here?
Hello:
Isn't there a constitutional reason why the elections have to be held on the first Tuesday in November? Rain or shine, they cannot postpone it?
By the way, the only bad news of the day WP poll still has Romney up 49-48. Darn it!
Thanks

(5,256 posts)It's not the first Tuesday in November. It's the first Tuesday after the first Monday. Your principal question can be answered with 30 seconds of Internet research. And, although you're not doing it right, thanks for your concern!

(18,219 posts)Congress sets the election day...the only condition is that it is the same day throughout the USA. Apparently Congress has never chosen to make a change to what the Constitution set as the timing at that time (that I know of). But they can.

(609 posts)I am banking on my Dem friends from DU and not time-consuming internet search when the time is tight. GOTV effort is all I do friend, not spending time on other things at least for 8 days.

(3,121 posts)The reason why elections are held on Tuesday was due to a 1848 law which made traveling on the sabbath illegal PLUS elections at the time was done at the county seed so it usually took a day to Travel there (Monday) had the election (Tuesday) Travel home (Wednesday)

(12 posts)And while the answers on the thread are indeed correct, to answer your question, there is no way to change Election Day without congressional approval, prior to the election.
