Comey supposedly has arrogantly prided himself on being above politics, yet he got himself totally immersed, both domestically and internationally, and nearly threw what may be the most critical election of our lifetimes. Comey may have made the best of bad choices. A Special Prosecutor could uncover the bad actors at the bureau. Knowing that the Trumpistas in the bureau were going to leak their story for political gain, Comey may have tried to limit the damage prior to the election. His ambiguous letter was non-committal. It was possibly designed to diffuse more vile leaks that he anticipated from the Gestapo cell operating in the New York office.

Let's put all of these agents (and Comey) on leave until a SP can drain the swamp. As I understand it, the Hatch Act does not carry criminal sanction. It only calls for firing. If money traded hands, further corruption charges would apply. No evidence yet of that. Phone calls to Rudy or the Trump campaign may, however, be criminal behavior.
