Please sign this WH petition to make Birthers pay for wasting tax dollars.

(Cross posted from GD)

The petition is self-explanatory:

Mandate the AG to seek sanctions, costs, and attorneys' fees to recover taxpayer funds used to defend birther lawsuits.

Full text:

Hundreds of repetitious and frivolous lawsuits have been filed challenging President Obama's status as a natural born citizen. These lawsuits have clogged up the courts and cost the taxpayers millions of dollars in court costs and attorneys' fees.

We, the taxpayers, respectfully petition for an Executive Order or directive to the Attorney General to seek to recover taxpayer funds expended in defending frivolous Birther lawsuits by requesting sanctions, costs, and attorneys' fees in each and every pending or future case.

There are established rules and procedures for recovering costs in litigation. I don't need or want the precedent set whereby those rules are somehow circumvented by Executive order. Sure, this time it would be to go against crazy oily t. But there will always be a next time.

Plus, having ridiculed these WH petition drives on more than one occasion, I think I'll sit out requests to participate in one.

It isn't cheap either to file a case, even if you have pro bono lawyers working for you. Someones fronts 100k, 200k to pay for all of that crap and I bet the lawyers they hire don't work for free.

A federal judge can impose sanctions under FRCP Rule 11 and Judge Clay D. Land did exactly that in Georgia. However an Assistant US Attorney could also ask for costs. The thing that needs to be done with Taitz is have her declared to be a vexatious litigant. Then she would have to seek permission to file another suit in the same district.

I know that these WH petitions are hopeless as far accomplishing any substantive change in policy on behalf of the Justice Dept. Unlike private attorneys they are very reluctant to punish a private person for filing a lawsuit against a government official even when it is frivolous as all of Taitz have been. They do not want to be seen as a bully and discouraging poor Mr. or Ms John Q. Public from exercising their rights for redress. What Taitz has done is beyond the pale however.

The real purpose this petition is to piss off Orly. She keeps getting her petition claiming Obama is "committing social security and identity fraud" pulled for violating the Terms of Participation. I didn't write this one but would like to see it surpass the number of signatures the first one Taitz submitted had before it got pulled.

Orly is not spending a lot of money on the cases. Federal filing fees are around $400. She is donating the time to write the motions herself. No one would pay her to write the childish crap she puts out. She has had help from time to time from amateurs, paralegals and even from a disbarred attorney, Charles Lincoln III. He helped get Orly sanctioned in Georgia when he wrote a scathing reply to Judge Land's Order to Show Cause. Besides filing fees her main expenses are probably travel and whatever lost opportunity she might have incurred from her dental office. No one knows the costs incurred by the Justice Department, the states like Hawaii and the courts for answering and ruling on these bundles of Taitz hatred but it has to be significant.
