They weren't complaining about it being on public access. They were trying to limit it being streamed

on sites that weren't licensed to stream it. They had no problem with it being streamed on Colbert's new youtube channel or on the Monroe County youtube channel or on the Late Show youtube channel.

and that is why they realized they needed to back down and let other youtube channels offer the episode.

Since they no longer rely on government funds and he could do a tell all show with guests.
