Throughout his time on the Supreme Court, Scalia had more in common with a medieval cleric at a witch-burning than a classical bourgeois jurist presiding over a court of law. Scalia determined the result first and then bludgeoned the law into the predetermined shape. Precedent, history and facts were ignored or falsified as necessary to produce the desired result.

Appointed by Ronald Reagan and confirmed unanimously in 1986 by Democrats and Republicans in the US Congress, Scalia’s career on the Supreme Court included some of the following highlights:

The stolen election of 2000. In December 2000, the Supreme Court intervened to halt the counting of votes in Florida and install George W. Bush in the White House. The 5-4 ruling in the case of Bush v. Gore, in which the justices cast their votes according to naked factional interests, was a milestone in the decay of American democracy. According to Scalia, “there is no universal right of suffrage.” When later asked about the ruling, Scalia angrily replied, “Get over it.”

Dictatorship and the “war on terror.” Scalia was a major force behind the infiltration of fascistic doctrines into Supreme Court jurisprudence, under the guise of phrases such as the “unitary executive theory,” “executive privilege,” the “separation of powers,” the president’s role as “commander in chief” and “deference” to the executive. Under these doctrines, the president enjoys unchecked “wartime” powers to override democratic rights, and the courts and judges have no power to intervene. The essential content of these doctrines is indistinguishable from the “state of exception” theory of Nazi “crown jurist” Carl Schmitt (1888-1985).

During Scalia’s tenure on the Supreme Court, the court refused to disturb lower court decisions using “state secrets” doctrine to block challenges to torture, spying and assassination. The Bush and Obama administrations consistently invoked the “state secrets” doctrine to block court proceedings that sought to expose their crimes. For example, lower courts invoked “state secrets” to refuse to hear the case of Mohamed v. Jeppesen Dataplan, Inc. in 2010, and the Supreme Court declined to hear the case in 2011, leaving the lower court decision intact.

In 2007, Robert F. Kennedy, Jr. told us the story about just-us Scalia at my alma mater, Wayne State University.



Kennedy called George W Bush "that sonofabitch" and said the guy was a crook, turning over the government to the lobbyists and gangsters who've emptied our Treasury; polluted our water, land, air and children; and used humanity as cannon fodder and slave labor. At that point, I yelled a particularly loud "Yeeeaaaaaahh!!!!!" which elicited a smile from the podium. He also pegged ABCNNBCBSFoxNoiseNutwork for what they are, corrupt.

Among other things, he called Antonin Scalia the son of a Nazi and explained why. It had to do with Tony's dad, who was one of the founders of the American fascist party, supporter of Mussolini and Hitler. I would've taken notes, but I wanted to hear everything the guy said. Alan Dershowitz chronicled the guy's beliefs.

That's history. What Gustavo Garcia and now Antonin Scalia face is eternity.

It’s appropriate that Supreme Court Justice Antonin Scalia died at a luxury resort while freeloading as the guest of thus far unidentified wealthy sponsors as one of 40 guests at a private quail-hunting vacation party.

The resort where he died, Cibolo Ranch Resort, located on land stolen by its founder from the Apache and Comanche people in the Big Bend region of west Texas, is a posh retreat favored by the ultra rich, offering rooms priced from $350 to $800 a night — and it’s a safe bet that the bed Scalia died in was located in a top-priced room — and that the credit card that was swiped to pay for it didn’t have his name on it. (According to one report, the guests at the gathering had their bills covered by the resort’s owner, John Poindexter, a mullti-millionaire real estate owner, rancher and former investment banker.)

The acerbic, blunt-speaking Scalia made his name as a High Court judge accepting freebies from wealthy businesspeople and right-wing outfits like the Federalist Society, even taking free trips and vacation junkets from the likes of the aptly-titled “Vice” President Dick Cheney back in 2004 when Cheney had a case pending before the court involving an effort to force the VP to disclose what oil company executives had attended a closed meeting in his office on energy policy early in the first term of the Bush-Cheney administration. (Scalia, notably, did not recuse himself from hearing that case.)

We don’t at this point know what Scalia’s final junket was about — Poindexter makes a point of saying it “wasn’t about politics or law — but it’s no surprise he wasn’t there on his own dime. It wasn’t the way Scalia operated. Indeed, so egregious and frequent were Scalia’s junkets that in October 2015 the New York Times wrote an editorial condemning them [1] and calling for a reform to make such legalized bribery illegal.

In February 2002, Saudi Prince Turki Al Faisal, head of Saudi intelligence from 1977 until September 1, 2001, traveled to Washington, D.C.

While there, Turki, who’d graduated from Georgetown University in the same class as Bill Clinton, delivered a speech at his alma mater that included an unexpected history lesson:

In 1976, after the Watergate matters took place here, your intelligence community was literally tied up by Congress. It could not do anything. It could not send spies, it could not write reports, and it could not pay money. In order to compensate for that, a group of countries got together in the hope of fighting communism and established what was called the Safari Club. The Safari Club included France, Egypt, Saudi Arabia, Morocco, and Iran … so, the Kingdom, with these countries, helped in some way, I believe, to keep the world safe when the United States was not able to do that. That, I think, is a secret that many of you don’t know.

Turki was not telling the whole truth. He was right that his Georgetown audience likely had never heard any of this before, but the Safari Club had been known across the Middle East for decades. After the Iranian revolution the new government gave Mohamed Hassanein Heikal, one of the most prominent journalists in the Arab world, permission to examine the Shah’s archives. There Heikal discovered the actual formal, written agreement between the members of the Safari Club, and wrote about it in a 1982 book called Iran: The Untold Story.

And the Safari Club was not simply the creation of the countries Turki mentioned — Americans were involved as well. It’s true the U.S. executive branch was somewhat hamstrung during the period between the post-Watergate investigations of the intelligence world and the end of the Carter administration. But the powerful individual Americans who felt themselves “literally tied up” by Congress — that is, unfairly restrained by the most democratic branch of the U.S. government — certainly did not consider the decisions of Congress to be the final word.

Whatever its funding sources, the evidence suggests the Safari Club was largely the initiative of these powerful Americans. According to Heikal, its real origin was when Henry Kissinger, then secretary of state, “talked a number of rich Arab oil countries into bankrolling operations against growing communist influence on their doorstep” in Africa. Alexandre de Marenches, a right-wing aristocrat who headed France’s version of the CIA, eagerly formalized the project and assumed operational leadership. But, Heikal writes, “The United States directed the whole operation,” and “giant U.S. and European corporations with vital interests in Africa” leant a hand. As John K. Cooley, the Christian Science Monitor’s longtime Mideast correspondent, put it, the setup strongly appealed to the U.S. executive branch: “Get others to do what you want done, while avoiding the onus or blame if the operation fails.”

This all seems like something Americans would like to know, especially since de Marenches may have extended his covert operations to the 1980 U.S. presidential election. In 1992, de Marenches’ biographer testified in a congressional investigation that the French spy told him that he had helped arrange an October 1980 meeting in Paris between William Casey, Ronald Reagan’s 1980 campaign manager, and the new Islamic Republic of Iran. The goal of such a meeting, of course, would have been to persuade Iran to keep its American hostages until after the next month’s election, thus denying Carter any last-minute, politically potent triumph.

De Marenches and the Safari Club certainly had a clear motive to oust Carter: They blamed him for allowing one of their charter members, the Shah, to fall from power. But whether de Marenches’ claims were true or not, we do know that history unfolded exactly as he and the Safari Club would have wished. The hostages weren’t released until Reagan was inaugurated, Reagan appointed Casey director of the CIA, and from that point forward America’s intelligence “community” was back in business.

Poppy Bush set the table in 1981 for what was to come -- via 'National Security'

What was surprising to me was Reagan’s condition. He was exhausted to the point of incoherence throughout much ofthe interview and could not remember the substance of any subject that had been discussed apart from Mitterrand’s expression of anticommunism. I had not seen Reagan at such close rangesince the assassination attempt nearly four months earlier, and was shocked at his condition.... Reagan simply was unable to recall the contents of the talks in which he had just participated.... The interview concluded at a signal from Deaver,who did not seem to find the president’s condition unusual.”

Thus ran Lou Cannon’s recollections of an interview with the Commander-in-Chief in 1981, as set forth in his book President Reagan: The Role of a Lifetime (New York: Simon & Schuster,1991), published earlier this year. But how did Cannon describe Reagan’s condition to the readers of the Washington Post when he wrote up his interview? In the July 23, 1981, Washington Post,Cannon’s story appeared under the headline “Reagan Describes Summit Meeting as ‘Worth Its Weight in Gold.’ ” Cannon’s report gives the impression of a lucid chief executive returning home after a fruitful colloquy with other western leaders at the economic summit held in Ottawa in mid-July. Cannon did mention in the tenth paragraph that “Reagan appeared tired to the point of near-exhaustion,” but this observation was quickly qualified by the opinion of “aides” that the president had been doing a lot of prep for the conference and was also worried about the Middle East.

Cannon shared his brief session with Reagan aboard Air Force One with Hedrick Smith of the New York Times, who similarly gave his readers the impression of a president in touch with things rather than the incoherent old man they had actually encountered. As did Cannon, Smith wove the few quotable remarks from Reagan into a tapestry of attributed presidential dicta passed on — and no doubt confected— by Meese, Deaver,and Speakes. It is clear from Cannon’s account of the conference itself that Reagan was fogged up throughout the actual conference, occasionally interjecting trivial observations or homely jokes into the proceedings and then relapsing into bemused silence. Cannon’s memoir is one more indication of the cover-up that took place in the wake of Hinckley’s assassination bid on March 30, 1981. At the time of the shooting, the press was full of phrases like “bouncing back,” “iron constitution,” and other terms indicating that Reagan had emerged from the ordeal in good shape. In fact Reagan very nearly died on the operating table and was a dotard afterwards. He never fully recovered.

Conclusion: Unless a president is actually dead, the WhiteHouse press corps can be relied upon to present him as both sentient and sapient, no matter how decrepit his physical and mental condition.

Mentally isn't physically. So, while Pruneface made head snaps on tee vee and saluted getting out of the chopper, Poppy Bush remained VP. He saw it as an opportunity to get appointed a Super Duper Presidential Helper in all things National Security, from dealing with the Iranians to making war in Central America and everywhere else around the planet where a communist might be dreaming of something more to life than nothing.



George Bush Takes Charge: The Uses of ‘Counter-Terrorism’

A paper trail of declassified documents from the Reagan‑Bush era yields valuable information on how counter‑terrorism provided a powerful mechanism for solidifying Bush's power base and launching a broad range of national security initiatives.

During the Reagan years, George Bush used "crisis management" and "counter‑terrorism" as vehicles for running key parts of the clandestine side of the US government.

Bush proved especially adept at plausible denial. Some measure of his skill in avoiding responsibility can be taken from the fact that even after the Iran‑Contra affair blew the Reagan administration apart, Bush went on to become the "foreign policy president," while CIA Director William Casey, by then conveniently dead, took most of the blame for a number of covert foreign policy debacles that Bush had set in motion.

The trail of National Security Decision Directives (NSDDS) left by the Reagan administration begins to tell the story. True, much remains classified, and still more was never committed to paper in the first place. Even so, the main picture is clear: As vice president, George Bush was at the center of secret wars, political murders, and America's convoluted oil politics in the Middle East.

Reagan and the NSC also used NSDDs to settle conflicts among security agencies over bureaucratic turf and lines of command. It is through that prism that we see the first glimmers of Vice President Bush's role in clandestine operations during the 1980s.

NSDD 159. MANAGEMENT OF U.S. COVERT OPERATIONS, (TOP SECRET/VEIL‑SENSITIVE), JAN. 18,1985

The Reagan administration's commitment to significantly expand covert operations had been clear since before the 1980 election. How such operations were actually to be managed from day to day, however, was considerably less certain. The management problem became particularly knotty owing to legal requirements to notify congressional intelligence oversight committees of covert operations, on the one hand, and the tacitly accepted presidential mandate to deceive those same committees concerning sensitive operations such as the Contra war in Nicaragua, on the other.

[font color="green"]The solution attempted in NSDD 159 was to establish a small coordinating committee headed by Vice President George Bush through which all information concerning US covert operations was to be funneled. The order also established a category of top secret information known as Veil, to be used exclusively for managing records pertaining to covert operations.

The system was designed to keep circulation of written records to an absolute minimum while at the same time ensuring that the vice president retained the ability to coordinate US covert operations with the administration's overt diplomacy and propaganda.

Only eight copies of NSDD 159 were created. The existence of the vice president's committee was itself highly classified.
[/font color] The directive became public as a result of the criminal prosecutions of Oliver North, John Poindexter, and others involved in the Iran‑Contra affair, hence the designation "Exhibit A" running up the left side of the document.

The Wall Street Journal’s eyebrow-raising story of how the presidential candidate and her husband accepted cash from UBS without any regard for the appearance of impropriety that it created.

The Swiss bank UBS is one of the biggest, most powerful financial institutions in the world. As secretary of state, Hillary Clinton intervened to help it out with the IRS. And after that, the Swiss bank paid Bill Clinton $1.5 million for speaking gigs. The Wall Street Journal reported all that and more Thursday in an article that highlights huge conflicts of interest that the Clintons have created in the recent past.

The piece begins by detailing how Clinton helped the global bank.

“A few weeks after Hillary Clinton was sworn in as secretary of state in early 2009, she was summoned to Geneva by her Swiss counterpart to discuss an urgent matter. The Internal Revenue Service was suing UBS AG to get the identities of Americans with secret accounts,” the newspaper reports. “If the case proceeded, Switzerland’s largest bank would face an impossible choice: Violate Swiss secrecy laws by handing over the names, or refuse and face criminal charges in U.S. federal court. Within months, Mrs. Clinton announced a tentative legal settlement—an unusual intervention by the top U.S. diplomat. UBS ultimately turned over information on 4,450 accounts, a fraction of the 52,000 sought by the IRS.”

Then reporters James V. Grimaldi and Rebecca Ballhaus lay out how UBS helped the Clintons. “Total donations by UBS to the Clinton Foundation grew from less than $60,000 through 2008 to a cumulative total of about $600,000 by the end of 2014, according to the foundation and the bank,” they report. “The bank also joined the Clinton Foundation to launch entrepreneurship and inner-city loan programs, through which it lent $32 million. And it paid former president Bill Clinton $1.5 million to participate in a series of question-and-answer sessions with UBS Wealth Management Chief Executive Bob McCann, making UBS his biggest single corporate source of speech income disclosed since he left the White House.”

The article adds that “there is no evidence of any link between Mrs. Clinton’s involvement in the case and the bank’s donations to the Bill, Hillary and Chelsea Clinton Foundation, or its hiring of Mr. Clinton.” Maybe it’s all a mere coincidence, and when UBS agreed to pay Bill Clinton $1.5 million the relevant decision-maker wasn’t even aware of the vast sum his wife may have saved the bank or the power that she will potentially wield after the 2016 presidential election.

As McClatchy noted last month in a more broadly focused article that also mentions UBS, “Ten of the world’s biggest financial institutions––including UBS, Bank of America, JP Morgan Chase, Citigroup and Goldman Sachs––have hired Bill Clinton numerous times since 2004 to speak for fees totaling more than $6.4 million. Hillary Clinton also has accepted speaking fees from at least one bank. And along with an 11th bank, the French giant BNP Paribas, the financial goliaths also donated as much as $24.9 million to the Clinton Foundation––the family’s global charity set up to tackle causes from the AIDS epidemic in Africa to climate change.”

...The book begins with a quote from George Kennan written in 1948... WWII had ended only a few years earlier, leaving the US on top of the heap and the rest of the major powers in ashes. Kennan wrote then, “We have about 50% of the world’s wealth but only about 6.3% of its population….In this situation we cannot fail to be the object of envy and resentment. (This resentment is certainly not surprising since the US and its fellow European colonialists and neocolonialists had gained that wealth by disposing of others, for example in the American Indian genocide, or by extracting from the “other” nearly cost free labor of others, for example, the Black slaves brought to the concentration camps of the South. jw) Our real task in the coming period is to devise a pattern of relationships which will permit us to maintain that position of disparity.”...

As WikiLeaks have shown, I don't think the government should have any business monetizing foreign policy by way of war. That's how Dulles Brothers, Nixon and the rest have done it, pretty much uninterrupted since 1947. It hasn't worked. At least, for the 99 percent of US citizens.

Hillary, the Banksters Committed 'Fraud,' Not 'Shenanigans'

Former Secretary of State Hillary Clinton, in her debate with Senator Sanders minutes ago, said that she went to Wall Street and told them to stop their "shenanigans." The context was that she was being asked to respond to the complaint that she was too close to on Wall Street billionaires. She had every incentive, therefore, to demonstrate how tough she would be on Wall Street.

In that context, the best she could muster was the pusillanimous "shenanigans." Here is a typical definition of that word with examples.

1. : a devious trick used especially for an underhand purpose
2. 2a : tricky or questionable practices or conduct --usually used in pluralb : high-spirited or mischievous activity --usually used in plural

Examples of SHENANIGAN
1. students engaging in youthful shenanigans on the last day of school
2. an act of vandalism that went way beyond the usual shenanigans at summer camp


Hillary cannot bring herself to use the "f" word in the context of Wall Street CEOs leading the largest and most destructive fraud epidemics in history - frauds that made them spectacularly wealthy. A few minutes later, Bernie said that "fraud" was Wall Street's business model.

Here is the reaction of another prominent official to the plight of the homeowners:

"Along with innovation came complexity, and complexity is the enemy of transparency. I had high school friends and grade school friends that got put into mortgages by unscrupulous brokers. Some lost their houses, and I spent time with them and looked at what they had been conned into accepting--they didn't understand what they were signing on for. It was despicable."

"Despicable." The person I am quoting is Hank Paulson, former head of Goldman Sachs, and Secretary of the Treasury under President Bush. Paulson is not by nature someone with great sympathy for the poor. Hillary urges us to believe that because she started as a lawyer for an NGO she has established that she is a person of exceptional empathy. But her 2007 speech to Wall Street was a direct test of character that she failed. Hank Paulson, the leader of the "Vampire Squid," won the test of reality and human sympathy and Hillary lost -- and it wasn't close.

Hillary could easily have gotten the issue correct by talking with Miller and Madigan to get the facts. Both AGs are leading endorsers of Hillary's campaign. Hillary did not investigate, she did not even take the step that Hank Paulson did and check with friends with real experience with foreclosures.

Hillary simply believed the banksters' myths about the crisis. She pronounced sentence on the people losing their homes who were the victims of the banksters' frauds. She implicitly cast the banksters as the victims of the homeowners. The best she could muster was to note that the banksters should have vetted the loans more carefully. What courage.
