Exclusive: McConnell ignores Trump's attacks and says 'I have the votes' in quest to make history

It’s become a throwaway line at former President Donald Trump’s campaign rallies: GOP senators must boot Mitch McConnell from the leadership position he’s held longer than any Republican in American history.

But McConnell has a message.

“I have the votes,” the Senate GOP leader said bluntly, indicating he’s locked down enough support to claim a new feat: The longest-serving Senate party leader ever, a record held by Democrat Mike Mansfield for more than four decades and which McConnell would surpass in the next Congress.

In a wide-ranging interview with CNN, McConnell weighed in on his outlook for the high-stakes battle for control of the Senate and warned President Joe Biden about how his nominees would be handled in a GOP majority. The GOP leader expressed his preference for a new Nebraska senator, defended votes that put him at odds with Republicans in the 50-50 Senate and steered clear of Trump’s brazen personal attacks against him and his wife, Elaine Chao – in an apparent attempt to avoid a distracting fight with the former President before the midterms.

Maggie Haberman interview by Stephen Colbert

In this interview, she gives some insight into her book, "Confidence Man." I found this background information interesting. I'd been considering getting the audio of the book and I did after listening to this discussion. I haven't gotten into it very far yet, but so far, it's a level-headed (as level-headed as you can be considering the subject) evaluation of Trump. I don't agree at all with those claiming she was hiding information for the book. That would have cost her her job. One thing some people don't realize is that journalism is a continuous process of discovery. A journalist with her background and accolades (among them a Pulitzer Prize for her reporting on Trump) knows what she's doing and how to do it.

It's a wonder she still speaks to me."

Trivia: For the "Make 'em Laugh" number, Gene Kelly asked Donald O'Connor to revive a trick he had done as a young dancer: running up a wall and completing a somersault. The number was so physically taxing that O'Connor, who smoked four packs of cigarettes a day at the time, ended up in a hospital bed for a week after its completion. He suffered from exhaustion and painful carpet burns. Unfortunately, an accident ruined all of the initial footage, so after a brief rest O'Connor agreed to do the difficult number all over again.

In Trump Case, Texas Creates a Headache for Georgia Prosecutors

A Texas court is thwarting Georgia prosecutors’ attempts to compel testimony from Texas witnesses as part of a criminal investigation into former President Donald J. Trump.

ATLANTA — Witnesses called to testify in a Georgia criminal investigation into former President Donald J. Trump and his allies have not always come willingly.

A number of them have fought their subpoenas in their home-state courts, only to have local judges order them to cooperate. That was the case with Trump-aligned lawyers John Eastman in New Mexico, Jenna Ellis in Colorado and Rudolph W. Giuliani in New York; Mr. Giuliani was also told by an Atlanta judge that he could come “on a train, on a bus or Uber” after his lawyers said a health condition prevented him from flying.

But the state of Texas is proving to be an outlier, creating serious headaches for Fani T. Willis, the Fulton County district attorney, who is leading the investigation into efforts by Mr. Trump and others to overturn his 2020 election loss in Georgia.

Last month, the Texas Court of Criminal Appeals, the state’s highest criminal court, thwarted Ms. Willis’s effort to force Jacki L. Pick, a Republican lawyer and pundit, to testify in Atlanta, saying that her subpoena had essentially expired. But in a pair of opinions, a majority of the judges on the all-Republican court went further, indicating that they believed the Georgia special grand jury conducting the inquiry may not have the legal standing to compel testimony from Texas witnesses.

Dearie Orders on Mar-a-Lago Filter Log Disputes

This morning, Special Master Judge Raymond J. Dearie filed an order regarding former President Donald Trump and the Justice Department's joint Log of Disputes for Filter Materials. An itemized list of documents within the privilege review team's custody from Aug. 30 was partially made public through a court filing error on Oct. 5, shedding light on some filter materials that remain disputed.

Dearie's order states that Trump will not assert attorney-client privilege or attorney work product for a range of 28 Bates-numbered materials under Filter A out of 137 Bates-numbered materials. Dearie ordered that these materials not under dispute for attorney-client privilege or attorney work product be sent to the Case Team, who will work with Trump to resolve or narrow the disputes regarding claims of executive privilege and designations pursuant to the Presidential Records Act by Oct. 22.

Dearie will review the rest of the documents within Filter A and Filter C (the latter of which was not accidentally made public) and "endeavor to promptly" issue a report making recommendations regarding Plaintiff’s assertions of attorney-client privilege and/or attorney work product doctrine. Some of the documents remaining under dispute within Filter A include an "unsigned letter from Kasowitz Benson & Torres to Robert Mueller dated 6/23/2017" and a number of National Archives and Records Administration-related documents.

Dearie ordered that materials within Filter B, all of which the parties jointly recommended need not be adjudicated by Special Master Dearie except one (B-076, which Dearie ultimately decided he did not need to adjudicate on), be returned to Trump by Oct. 10. Dearie did, however, direct the Privilege Review Team to retain a control copy of the materials.

FBI gives evidence to tie militia to Gov. Whitmer plotters

Prosecutors on Friday played secretly recorded audio from a 2020 meeting in the basement of a vacuum shop as they tried to show jurors how a paramilitary group was connected to a plot to kidnap Michigan Gov. Gretchen Whitmer.

It was contemptuous talk about police and politicians in the makeshift home of Adam Fox — who was recently convicted of conspiring to abduct Whitmer — as a step toward kicking off a U.S. civil war, known to extremists as the “boogaloo.” The FBI intervened in the fall of 2020.

Joe Morrison, Paul Bellar and Pete Musico, members of a group called the Wolverine Watchmen, are charged with providing material support to Fox and others, though they’re not accused of directly participating in the kidnapping scheme.

“I like how you guys roll, man,” Fox said at the Vac Shack, according to the audio recorded by an FBI informant.

Man pleads guilty to seditious conspiracy for Capitol attack

WASHINGTON (AP) — A North Carolina man pleaded guilty Thursday to plotting with other members of the far-right Proud Boys to violently stop the transfer of presidential power after the 2020 election, making him the first member of the extremist group to plead guilty to a seditious conspiracy charge.

Jeremy Joseph Bertino, 43, has agreed to cooperate with the Justice Department’s investigation of the role that Proud Boys leaders played in the mob’s attack on the U.S. Capitol on Jan. 6, 2021, a federal prosecutor said. U.S. District Judge Timothy Kelly agreed to release Bertino pending a sentencing hearing that wasn’t immediately scheduled.

Bertino also pleaded guilty to a charge of unlawfully possessing firearms in March 2022 in Belmont, North Carolina. Kelly accepted his guilty plea to both charges during a brief hearing after the case against Bertino was filed Thursday.

Justice Department prosecutor Erik Kenerson said estimated sentencing guidelines for Bertino’s case recommend a prison sentence ranging from four years and three months to five years and three months. The Civil War-era seditious conspiracy charge carries a maximum sentence of 20 years in prison.
