If all this is is that he possessed secret documents, the precedent for that is that you get fined, and maybe probation, and lose your security clearance for a few years (refer to Sandy Berger).

There is a difference between a violation of the Espionage Act and spying in the sense that most of us imagine. To prove actual espionage would be a high bar.
