There is also the issue of plausible deniability. It is the greatest war crime after all, with serious consequences for the perpetrator. Not the least of which is pariah status.

You might be able to argue lack of intent and unintended consequences but that case has yet to be made.

Genocide is not simply the numbers killed, or the percentage of population. It's the physical and mental destruction and harm to a people. It's the destruction of the conditions that sustain and protect life. Gaza's children are now stunted for life, physically, developmentally and mentally. The trauma is immeasurable. The destruction of the hospital and medical system, water and sanitation infrastructure, school system, all its universities even, the banning or restriction of baby formula, the delays with the polio vaccine for children, the systemic and willful obstruction of life-saving medicine and food aid - all these things are part of it. You have to look at the big picture and how all these parts, as bad as each one is, together form something much worse.

However this situation is about ethnic cleansing, which may or may not be accompanied by genocide. I think what's happening in the north of Gaza is a pretty classic example of ethnic cleansing. To be proven when these people are refused their right of return.All clues are currently pointing to that being the case.
