"without prejudice." Suppose Jack Smith didn't move for the dismissal. Trump's lawyers would have filed the motion right after he took office, and they would have asked for the case to be dismissed "with prejudice."
"With prejudice" would mean that even if a miracle occurs and Trump get impeached and convicted, he could never be charged again with these charges. "Without prejudice" means the DOJ would have the opportunity to press the charges again.
So let's save the criticism till we see what he and Garland do about a final report. If they don't publish a final report, we should rake them over the coals.
